The tenant rental agreement

The type of contract that we advise the owner to stipulate with the tenant is valid for a period ranging from 1 to 18 months. This is a “Lease for residential use for tourist and cultural purposes” pursuant to Article 1, paragraph II, letter c), Law No. 431 of December 9, 1998.
It is not a temporary lease, as in Milan it is not free.
The owner stipulates the rental contract directly with the tenant, a private individual, and therefore the “dry coupon” regime can be applied, but with a company / agency it is not possible.

Compared to the “classic” rental contract (eg “4 + 4”):

no risk for tenants to extend the rent beyond the agreed term; it is in fact mainly people who come from abroad and need to live in Milan for short periods for work, study or vacation reasons. The motivation of their stay is specified in the contract (for example, the enrollment certificate for the Master’s degree is attached);
tenants are referenced people, often enrolled in high-level university masters, mostly with compulsory attendance and rather expensive;
thanks to the cleaning service, at least once a month and accepted by the tenant by contract, the apartment will always be “under control”;

the apartment is used less, therefore less worn and “personalized”;

difficulties in tax regularization (the remuneration received must be included in the declaration of income under the item “different income”);
rental contracts must be registered only if they have a duration of more than 30 days;
obligation to “transfer the building” to the Police within 48 hours, which appears automatically with the registration of the contract only for tenants of the European Community;
expenditure of time and energy for the management of promotion / requests / reservations / checkin / checkout / cleaning / maintenance / repairs;
the tourist tax is due;
obligation to fill out a form for the condominium administrator with the details of who is occupying your apartment, which can leave you stranded!
=> if you entrust the management of short rents to an agency that manages all the procedures, you will probably not be able to enter into a rental contract with the tenant, a natural person, in which you can apply the regime of dry coupon (21% only on rent , net of expenses / services); you will go instead to receive the remuneration from the agency on which you will pay taxes according to your personal income tax rate.

I have a degree in Public Relations and IULM University in 2000.
I worked in Roberto Cavalli, an Italian fashion brand, press office for 1 year and for 6 years as media planner for 2 large international advertising agencies in Milan.
